Veruntreuung, Erpressung, Nötigung, Wucher

(Berufung gegen das Urteil des Strafgerichts vom 31. August 2018, SGO 2017 4);-

hat der Kantonsgerichtspräsident,

nachdem sich ergeben und in Erwägung:

  • dass das Strafgericht den Beschuldigten C.________ mit Urteil vom 31. August 2018 von Schuld und Strafe freigesprochen hat;

  • dass Rechtsanwalt F.________ als damaliger Rechtsvertreter der Privatkläger A.________ und B.________ AG am 7. September 2018 namens seiner Klienten fristgerecht Berufung angemeldet hat (Art. 399 Abs. 1 StPO) und ihm das begründete Urteil am 9. Januar 2019 zugestellt wurde (vgl. Zustellbeleg, Beilage zum Vi-Urteil);

  • dass Rechtsanwalt F.________ mit Schreiben vom 17. Januar 2019 mitteilte, dass seine Mandate erloschen seien (KG-act. 5);

  • dass innert der zwanzigtägigen Frist von Art. 399 Abs. 3 StPO, welche am 29. Januar 2019 endete, keine Berufungserklärung eingegangen ist;

  • dass die Befristungen für Berufungsanmeldung und -erklärung Gültigkeitsvorschriften sind, sodass zur gültigen Einlegung einer Berufung der diesbezügliche Wille zweimal zu erklären ist, abgesehen vom Fall, in welchem ein Urteil direkt begründet zugestellt wird (BGE 138 IV 157 , E. 2.1 f.; Luzius Eugster, in: Basler Kommentar StPO, 2. Auflage, Art. 399 N 1 StPO; Markus Hug, in: Donatsch/Hansjakob/Lieber, Kommentar zur Schweizerischen Strafprozessordnung, Art. 399 N 10 f.; a.M. Schmid StPO PK, Art. 399 N 10 f. und 403 N 4);

  • dass damit die Berufung zwar angemeldet, aber nicht erklärt worden ist, was auf einen nachträglichen Verzicht hinausläuft, weshalb praxisgemäss nicht nach Art. 403 Abs. 1 lit. a und Abs. 3 StPO zu verfahren, sondern die Berufung im Verfahren nach § 40 Abs. 2 JG präsidial abzuschreiben ist (Art. 386 StPO und STK 2012 22 vom 7. Mai 2012);

  • dass die Gerichtskosten der zweiten Instanz bei diesem Ausgang zu Lasten des Staates gehen und Entschädigungen mangels Aufwands nicht zu sprechen sind;-

verfügt:

1. Die Berufung wird als durch Verzicht auf Berufungserklärung erledigt abgeschrieben.

2. Die zweitinstanzlichen Gerichtskosten von Fr. 300.00 gehen zu Lasten des Staates.

3. Gegen diesen Entscheid kann innert 30 Tagen seit Zustellung nach Massgabe von Art. 78 ff. des Bundesgerichtsgesetzes *Beschwerde in Strafsachen * beim Bundesgericht in Lausanne eingereicht werden. Die Beschwerdeschrift muss den Anforderungen von Art. 42 BGG entsprechen.

4. Zufertigung an A.________ (1/R), die B.________ AG (1/R), Rechtsanwalt D.________ (2/R, inkl. Beilage KG-act. 5 in Kopie), die Oberstaatsanwaltschaft (1/R), die kantonale Staatsanwaltschaft (1/A, inkl. Beilage KG-act. 5 in Kopie), die Vorinstanz (1/ü) sowie nach definitiver Erledigung an die Vorinstanz (1/ES, die Rückgabe der Akten erfolgt nach Erledigung des Verfahrens STK 2019 4; zum Vollzug des Urteils in Sachen C.________ und Erstattung der nötigen Meldungen) und an die Kantonsgerichtskasse (1/ü, im Dispositiv).
