Résumé Omnilex

A private complainant appealed a criminal judgment for neglect of maintenance duties but failed to submit an appeal declaration within the statutory deadline. The Schwyz Cantonal Court held that the appeal notice alone was insufficient and that the missing declaration amounted to a subsequent waiver. It therefore struck the appeal off rather than proceeding under the ordinary appeal mechanism. Second-instance court costs of CHF 300 were put on the state, and no compensation was awarded.

Regeste Omnilex

Art. 399 Abs. 1 und 3 StPO; validity requirements for appeal notice and appeal declaration; where the appellant timely files an appeal notice but omits the appeal declaration within the statutory period, the appeal is not validly perfected. The omission constitutes a subsequent waiver, so the proceeding is to be struck off administratively rather than handled as an appeal under Art. 403 StPO (consid. 1). Costs of the second instance may be charged to the state when the appeal is terminated on this basis; no compensation is due absent compensable effort (consid. 2).

Question juridique clé

Whether the appeal had to be dismissed because no appeal declaration was filed after the appeal notice.

Solution extraite

The appeal was treated as completed by waiver of the appeal declaration and was struck off.

Motifs extraits

The time limits for appeal notice and appeal declaration are validity requirements; since the notice was filed but no declaration followed, this amounted to a subsequent waiver. Therefore the appeal was not to be handled under Art. 403 StPO but struck off by the presiding judge.

Question juridique clé

Allocation of second-instance court costs and compensation

Solution extraite

Second-instance court costs of CHF 300 were borne by the state, and no compensation was awarded.

Motifs extraits

Because of the procedural outcome and lack of compensable effort, costs were assigned to the state and no indemnity was due.
