Résumé Omnilex

The Schwyz Cantonal Court president dealt with an appeal by the accused against a first-instance criminal judgment for assistance after the accused had filed only the notice of appeal. Although the notice was timely, no appeal statement was filed within the 20-day period after service of the reasoned judgment. The court held that the appeal requirements are validity requirements and that the omission amounted to a waiver of the appeal statement. The appeal was therefore struck out administratively. Second-instance costs of CHF 300 were placed on the state, and no compensation was granted.

Regeste Omnilex

Art. 399 Abs. 1 und 3 StPO; Art. 386 StPO; appeal notice and appeal statement as validity requirements. Unless the reasoned judgment is served directly, a valid appeal requires two separate expressions of intent: timely notice of appeal and timely appeal statement. If the appeal statement is not filed within the statutory period, the appeal is deemed waived and may be struck out without resort to the withdrawal procedure under Art. 403 StPO. In such a case, the second-instance costs may be charged to the state; compensation is denied where no compensable effort has been incurred.

Question juridique clé

Whether the appeal had to be struck out because no appeal statement was filed after the notice of appeal.

Solution extraite

The appeal was not properly perfected: the notice of appeal was filed in time, but the appeal statement was not filed within the 20-day deadline, which amounted to a later waiver.

Motifs extraits

The deadlines for appeal notice and appeal statement are validity requirements; absent direct service of a reasoned judgment, the intention to appeal must be expressed twice. Since only the notice was filed, the appeal was to be administratively closed rather than processed under the provisions governing withdrawal.

Question juridique clé

How to allocate second-instance court costs and whether compensation was due.

Solution extraite

Second-instance court costs of CHF 300 were charged to the state, and no compensation was awarded because no compensable effort arose.

Motifs extraits

Because the appeal was disposed of without substantive proceedings, costs were borne by the state and no party compensation was justified.
