In a correction order, the president of the Schwyz cantonal court amended the heading of an earlier decision in a vehicle-seizure complaint case. The date had been stated incorrectly as 14 May 2019; it was corrected ex officio to 14 June 2019. The court held that such a rubric error is not governed by Art. 334 ZPO, which concerns only the operative part, but may be corrected at any time under Art. 238 lit. a-c ZPO.
Art. 238 lit. a-c ZPO; correction of errors in the rubric of a decision. Obvious clerical mistakes in the heading, including an incorrect date, may be corrected at any time and ex officio. The correction mechanism of Art. 334 ZPO applies only to the dispositive part and is therefore not relevant to the rubric. A faulty party designation or similar rubric error does not require further formal prerequisites for amendment (consid. 1).

hat der Kantonsgerichtspräsident,
in Erwägung:
dass im Rubrum der Verfügung BEK 2019 109 betreffend die Beschwerde gegen den Beschlagnahmebefehl der Staatsanwaltschaft Höfe Einsiedeln vom 28. Mai 2019, SUE 2019 343, aus Versehen der 14. Mai 2019 als Datum der Verfügung anstelle des richtigen Datums vom 14. Juni 2019 angegeben worden ist;
dass die Berichtigung des Rubrums nicht unter Art. 334 ZPO fällt, welcher nur das Dispositiv betrifft, und die Berichtigung des Rubrums gemäss Art. 238 lit. a-c ZPO, wie z.B. einer fehlerhaften Parteibezeichnung ohne weitere Voraussetzungen jederzeit und auch von Amtes wegen erfolgen kann (vgl. Tanja Domej, in: Paul Oberhammer/Tanja Domej/Ulrich Haas [Hrsg.], Schweizerische Zivilprozessordnung, Art. 83 ZPO N 2);-
verfügt:
1. Die Verfügung BEK 2019 109 wird im Rubrum hinsichtlich des Datums wie folgt berichtigt (Änderungen in Kursivschrift):

2. Zufertigung an Rechtsanwalt B.________ (2/R), die Oberstaatsanwaltschaft (1/R), die Staatsanwaltschaft Höfe Einsiedeln (1/A) sowie nach definitiver Erledigung an die die Staatsanwaltschaft Höfe (1/R) und an die Kantonsgerichtskasse (1/ü, im Dispositiv).

Yes. The heading was corrected ex officio to state 14 June 2019 instead of 14 May 2019.
The wrong date in the rubric was an obvious clerical error. Such errors in the heading can be corrected at any time and of the court's own motion; the provision on correction of the operative part does not apply.
