The Civil Chamber of the Obergericht held that the appellant’s recourse against interim measures under Art. 145 ZGB was wholly unfounded. Because the appeal was hopeless, free legal aid could not be maintained for the proceedings. The court therefore held that the appeal costs fall in principle on the appellant, with the Canton of Solothurn advancing them temporarily under the procedural rules. It further denied any compensation to the appellant’s lawyer, while ordering that counsel for the respondent be remunerated directly from public funds.

Sein Rekurs gegen vorsorgliche Massnahmen nach Art. 145 ZGB erwies sich als völlig unbegründet. 7. (...) Dann aber kann die unentgeltliche Rechtspflege nicht gewährt werden (§ 106 Abs. 2 ZPO). Überflüssige Prozesshandlungen sind nicht zu honorieren (SOG 1986 Nr. 7, Erw. 2). Die Kosten des Rekursverfahrens erliegen somit grundsätzlich auf dem Rekurrenten.
