The Anklagekammer held that compensation for disadvantages under § 36 StPO and party compensation under § 37 StPO may be reduced or refused only on the same grounds as a costs order against the accused. Such a departure is justified only if the accused caused or worsened the investigation by reprehensible or reckless conduct. In principle, the compensation decision should follow the allocation of procedural costs. The decision is framed by §§ 36 f. StPO and Art. 6(2) ECHR.

Die Herabsetzung oder Verweigerung einer Entschädigung für Nachteile gemäss § 36 StPO bzw. einer Parteientschädigung gemäss § 37 StPO ist unter den gleichen Voraussetzungen zulässig, wie die Kostenauflage zu Lasten des Beschuldigten (SOG 1991 Nr. 32).Sie kommt nur in Frage, wenn der Beschuldigte die Untersuchung durch verwerfliches oder leichtfertiges Verhalten veranlasst oder erschwert hat. Das bedeutet, dass der Entscheid über die Ausrichtung von Entschädigungen gemäss § 36 f. StPO grundsätzlich demjenigen über die Tragung der Verfahrenskosten zu folgen hat (vgl.
