The Criminal Chamber of the Obergericht clarified the effect of cassation proceedings on the prosecution limitation period. It held that a conviction by the district court president ends the limitation period when pronounced; if that conviction is later quashed, the limitation period is suspended during the cassation complaint proceedings and resumes only afterward. By contrast, if cassation is filed against an acquittal, the limitation period continues to run.
