The Obergericht Strafkammer held that under Art. 28 StGB a criminal complaint may be limited to acts already committed. In cases involving a continuing course of conduct, the complaint does not automatically extend to later acts committed afterwards. The decision clarifies that the complainant must expressly cover later conduct if it is to be prosecuted.
Art. 28 StGB; scope of a criminal complaint in continuing offences: a criminal complaint is effective only for the partial acts already committed at the time of filing. Where a prohibited conduct continues over time, the complaint does not by operation of law encompass subsequent acts committed later. The temporal reach of the complaint is determined by its content and the acts actually covered; future conduct requires its own inclusion or a new complaint (consid. unspecified).
