The Administrative Court held that under § 82bis of the Land Improvement Ordinance, land-improvement projects whose cost-allocation plan has already been published must be completed under the former law. In two-stage cost-allocation procedures, the decisive publication is the first one: the publication of the guidelines and basic elements. The later publication serves only to implement the approved framework and does not restart the applicable legal regime. The court therefore treated the earlier publication date as controlling for intertemporal purposes.

In den Bodenverbesserungsverfahren, bei denen die Kostenverteilung in zwei Etappen aufgelegt wird, ist die erste Auflage, nämlich diejenige der Richtlinien und Grundelemente massgeblich. Die Bodenverbesserungsverordnung enthält eine bei der Revision von 1979 eingeführte intertemporalrechtliche Vorschrift, nämlich § 82bis Nach ihr sind alle Bodenverbesserungsunternehmen, bei denen der Kostenverteilungsplan bereits aufgelegt worden ist, nach dem bisherigen Recht abzuschliessen. In den Bodenverbesserungsverfahren, bei denen die Kostenverteilung in zwei Etappen aufgelegt wird, ist die erste Auflage, nämlich diejenige der Richtlinien und Grundelemente, die für § 82bis massgebliche Auflage, da die zweite Auflage nur noch die Ausführung der genehmigten Richtlinien und Grundelemente enthält. Es wäre intertemporalrechtlich gesehen unsinnig, die Rechtsänderung ausgerechnet zwischen der Festsetzung der Grundelemente und der Ausführung der Grundelemente eintreten zu lassen. Sinnvoll ist vielmehr, wenn die Richtlinien und Grundelemente, die noch unter der Herrschaft des alten Rechts aufgelegt worden sind, für die detaillierte Kostenverteilung massgeblich bleiben, so dass diese letztere vom neuen Recht nicht mehr berührt wird. * Verwaltungsgericht, Urteil vom 8.
