The Verwaltungsgericht held that a guardianship order made on a person's own request cannot later be undone by withdrawing that request in the appeal proceedings. Neither Art. 372 ZGB nor cantonal law allows such a withdrawal. The complaint could therefore not be used to attack the Oberamtmann's order by combining revocation of the request with the appeal.

Art. 372 ZGB; § 123 EGZGB; §§ 66 ff. VRG: Once a guardianship measure has been ordered at the request of the person concerned, that request may no longer be withdrawn in appellate proceedings. Federal law does not infer any right of revocation from Art. 372 ZGB, and cantonal law likewise provides none. The considerations militating against admission of a revocation in the federal appeal stage apply equally in the cantonal administrative-judicial procedure (consid. corresponding). A complaint cannot therefore be founded on the later withdrawal of the request combined with an appeal against the authority's order.

Ist die Entmündigung auf eigenes Begehren einmal ausgesprochen worden, so kann das Entmündigungsbegehren nicht mehr zurückgezogen werden. Wie das Bundesgericht im Entscheid BGE 102 II 190 festgestellt hat, kann aus dem Bundesrecht keine solche Rückzugsmöglichkeit abgeleitet werden. Aber auch das kantonale Recht gibt keine solche Möglichkeit. Was das Bundesgericht gegen die Zulassung eines Widerrufs noch im Rechtsmittelverfahren vorbringt, spricht auch gegen eine Auslegung des kantonalen Rechts, welche darauf hinausliefe, dass im Verfahren vor Verwaltungsgericht noch ein Widerruf des Entmündigungsbegehrens möglich wäre. Die Verfügung des Oberamtmannes nach § 123 EGZGB kann also nicht vermittelst Widerruf des Entmündigungsbegehrens, kombiniert mit Beschwerdeführung, angefochten werden. * Verwaltungsgericht, Urteil vom 1.
