The Obergericht, Strafkammer, held that an injured party cannot file a cross-appeal in the criminal appeal system governed by §§ 174 and 175 StPO. Since such a remedy is excluded by the structure of § 174 StPO, it is not covered by § 175 StPO. The court therefore rejected the attempt to assert an Anschlussappellation.

Da das Gesetz in § 175 StPO nur die Anschlussappellation des Berechtigten regelt und der Verletzte im System des § 174 StPO nicht als Anschlussappellant erscheint, besteht kein Raum für eine analoge oder ergänzende Zulassung. Die fehlende Erwähnung des Verletzten in § 175 StPO bestätigt den Ausschluss des Rechtsbehelfs.

A cross-appeal by the injured party is not available under the appeal system of § 174 StPO and is therefore not mentioned in § 175 StPO.
