Résumé Omnilex

In a building-law dispute concerning terrain changes, the Administrative Court held that § 53 NBR is a mixed-law provision. The rule serves both public interests, in particular protection of the local and landscape image, and private interests in maintaining boundary distances. Construed in this way, it functions as a distance rule for terrain changes and is limited to the boundary-distance area. The decision relies on the structure of the provision, the interests involved, and established Solothurn doctrine and practice recognizing private-law distance rules within building legislation.

Regeste Omnilex

§ 53 NBR; terrain changes; mixed-law provisions; boundary-distance rules. A building regulation may simultaneously contain public-law and private-law elements where, by its structure and protected interests, it serves both spatial-planning objectives and neighboring-property protection. In Solothurn, private-law distance rules can be embedded in cantonal and communal building legislation. A provision on terrain changes is therefore to be construed as a mixed-law norm and, in substance, as a boundary-distance rule; its scope is limited to the area governed by boundary-distance requirements (consid. not stated).

* Verwaltungsgericht, Urteil vom 28. Dezember 1977

Question juridique clé

Whether § 53 NBR on terrain changes is a mixed-law provision or purely public law.

Solution extraite

§ 53 NBR is a mixed-law provision, combining private-law and public-law elements.

Motifs extraits

Given the structure of § 53(1) NBR and the interests at stake, the court treated the rule not only as serving protection of the local and landscape image, but also as a private-law distance rule.

Question juridique clé

Whether the rule on terrain changes applies only within the boundary-distance area.

Solution extraite

The provision is to be understood as a boundary-distance rule for terrain changes and thus applies only in that area.

Motifs extraits

The court relied on the earlier view of the Regierungsrat and on the long-standing doctrine and case law in Solothurn that private distance rules also appear in communal and cantonal building legislation.
