The Obergericht’s civil chamber considered the wife’s request that her husband advance her divorce litigation costs. SOG 1977 Nr. 2 ** Art. 145, Art. 159 Abs. 3 ZGB*.Voraussetzungen für die Pflicht des Ehemannes, der Ehefrau im Scheidungsprozess einen Prozesskostenvorschuss zu leisten.* Die Pflicht des Ehemannes, der Ehefrau für das Scheidungsverfahren einen Anwaltskostenvorschuss zu leisten, ergibt sich aus der gegenseitigen Beistandspflicht der Ehegatten gemäss Art. 159 Abs. 3 ZGB (Komm. Bühler, N 260 zu Art. 145).Voraussetzungen dazu sind, dass Klage oder Rechtsmittel bei summarischer Prüfung nicht von vornherein als offenkundig aussichtslos oder als mutwillig erscheinen. Die Zusprechung eines Prozesskostenvorschusses setzt voraus, dass der Ehegatte, der ihn verlangt, für die Finanzierung des Prozesses auf den Beistand des andern Teils angewiesen ist und dass andererseits der angesprochene Ehegatte in der Lage ist, diesen Kostenvorschuss zu leisten (Komm. Bühler, N 268 zu Art. 145). Hierüber entscheidet der Richter nach freiem Ermessen. Im vorliegenden Fall ist nun zwar der Ehemann durchaus in der Lage, den Anwaltskostenvorschuss an seine Frau zu leisten, doch kann nicht gesagt werden, dass auf Seiten der Ehefrau Beistandsbedürftigkeit vorliege. Wenn nämlich der Ansprecher ohne Beeinträchtigung des angemessenen Lebensunterhaltes in der Lage ist, rechtlich oder tatsächlich und binnen nützlicher Frist über eigene Mittel zu verfügen und für die Anwaltskosten selber aufzukommen, liegt keine Beistandsbedürftigkeit vor (Komm. Bühler, N 269 zu Art. 145).Die Ehefrau verfügt über ein monatliches Einkommen von insgesamt Fr. 4'330.--.
