In der Begründung seines Rekurses gegen eine einstweilige Verfügung machte der Gesuchsgegner geltend, der Gesuchsteller habe an der Augenscheinsverhandlung, die unmittelbar der Entscheidfällung vorausging, sein Rechtsbegehren modifiziert, was unzulässig gewesen sei. - Das Obergericht führt dazu folgendes aus: Die allgemeinen und speziellen Bestimmungen des ordentlichen Prozessverfahrens finden im Summarprozess nur insofern Anwendung, als dadurch das Wesen dieser besonderen Verfahrensart nicht beeinträchtigt wird. Das summarische Verfahren ist gekennzeichnet durch die Beschränkung des Prozessstoffes und des Verfahrens zum Zwecke der Prozessbeschleunigung. So werden die Anspruchsvoraussetzungen und die Beweisführung formell und materiell vereinfacht. Es hätte einen wesentlichen Formalismus bedeutet, wenn der Summarrichter das modifizierte Gesuch anlässlich der Entscheidverhandlung an der im ordentlichen Verfahren sich stellenden Frage einer Klageänderung gemessen hätte. Es genügt im Summarverfahren vollauf, wenn die Umschreibung des Gesuches dem durch die einstweilige Verfügung befolgten und gesetzlich erlaubten Zweck entspricht. Die mündliche Neuformulierung des schriftlichen Gesuches vom 18. Dezember 1975, anlässlich der Verhandlung vom 29. Dezember 1975, war durchaus zweckmässig. Ein Vorentscheid über die Zulässigkeit oder Unzulässigkeit der Gesuchsformulierung mit Eintreten oder Nichteintreten, wie dies der Rekurrent offenbar wünschte, war überflüssig, abgesehen davon, dass mit dem Entscheid über das Gesuch auch über das Eintreten entschieden ist. Die Verfahrensbemängelungen, die der Rekurrent - nicht ganz verständlicherweise - im Rechtsmittelverfahren mit "Prozesseinrede" bezeichnet, sind unbehelflich. Der Grundsatz der Gewährung des rechtlichen Gehörs wurde nicht verletzt, indem der Nichteintretensantrag implizite Beurteilung fand. * Obergericht Zivilkammer, Urteil vom 8. April 1976*
