Résumé Omnilex

In a divorce appeal, the civil chamber held that a legal aid lawyer who wants to contest the amount of his own remuneration must do so in his own name. An appeal filed only in the client's name is not admissible as to the fee note, because the client is not directly aggrieved by a too-low legal-aid compensation. The court therefore did not enter into the appeal on that point.

Regeste Omnilex

§ 112 ZPO; standing of legal aid counsel to challenge the amount of the fee note: the fixation of the legal-aid remuneration directly affects the lawyer, not the represented party. The party is not adversely affected by a too low fee note, since the statute protects it against additional claims and may even make the party benefit if reimbursement is later sought from it. Consequently, counsel must file a remedy in his own name if he seeks to contest the amount of his compensation; a remedy lodged only in the client's name is inadmissible with respect to that issue (consid. 2).

SOG 2008 Nr. 8 § 112 ZPO. * Obergericht Zivilkammer, Urteil vom 7. November 2007 (ZKAPP.2007.17)*

Question juridique clé

Whether legal aid counsel may challenge the amount of his fee note by appealing in the client's name

Solution extraite

The fee note directly affects the lawyer's own legal position; therefore, if he wants to contest the amount of his remuneration, he must file the appeal in his own name.

Motifs extraits

The represented party is not prejudiced by an allegedly too low fee note because the law protects it from additional claims by the lawyer and may even benefit it if the state later seeks reimbursement from the party. The lawyer therefore lacks standing to attack that part of the judgment in the client's name.
