Whether the conditions for non-disclosure of the enforcement to third parties under Art. 8a(3)(d) SchKG were met at the time of the office decision.
At the time of the enforcement office's decision, the conditions were not yet excluded by a pending opposition-removal proceeding; however, the later filing of such a proceeding meant the enforcement could again be disclosed to third parties.
The provision also covers partially disputed claims, not only clearly abusive enforcements. The creditor must prove timely initiation of opposition-removal proceedings; a conciliation request for an acknowledgment action qualifies as such a proceeding, and later filing can restore third-party visibility.
