II.

2.a) Wie bereits im Entscheid vom 31. Oktober 2013 (Erw. II/2a mit Hinweisen) ausgeführt wurde, handelt es sich beim Entscheid über die Gewährung bzw. Verweigerung der unentgeltlichen Rechtspflege um einen prozessleitenden Entscheid (vgl. Leuenberger/Uffer-Tobler, Schweizerisches Zivilprozessrecht, N 8.18), der nur formell, jedoch nicht materiell rechtskräftig wird, weshalb ein neues Gesuch nicht grundsätzlich ausgeschlossen ist. Allerdings gewährt Art. 29 BV nicht den Anspruch darauf, dass sich das Gericht voraussetzungslos mit einem neuen Gesuch befasst, da der Prozessverschleppung sonst Tür und Tor geöffnet wäre. Ein neuerliches Gesuch um unentgeltliche Rechtspflege auf der Basis desselben Sachverhalts hat deshalb den Charakter eines Wiedererwägungsgesuchs, auf dessen Beurteilung von Verfassungs wegen kein Anspruch besteht (BGer 5A_430/2010 E. 2.4; vgl. auch ZR 106 (2007) Nr. 55; Bühler, Berner Kommentar, N 71 zu Art. 119 ZPO).

Anders stellt sich die Situation dar, wenn sich die finanziellen Verhältnisse seit dem abweisenden Entscheid zum ersten Gesuch erheblich geändert haben (echte Noven) oder wenn sich der erste Entscheid zufolge Entdeckung neuer Beweismittel oder Tatsachen (unechte Noven), die dem Gesuchsteller im früheren Verfahren noch nicht bekannt, aber schon vorhanden waren, deren Geltendmachung ihm aber damals unmöglich war oder für ihn keine Veranlassung bestand, als unrichtig erweist. In solchen Fällen besteht der aus der Garantie eines fairen Verfahrens (Art. 29 Abs. 1 BV) abgeleitete Anspruch auf Prüfung des erneuten Gesuchs um unentgeltliche Rechtspflege und das Gericht hat darauf einzutreten.
