A request lodged together with the appeal response is therefore admissible. In appeal proceedings, the costs incurred in drafting the response may be included in the security assessment when the request is made at that stage. Employment disputes are not governed by Art. 243(2) ZPO; as pecuniary disputes under Art. 243(1) ZPO they remain subject to simplified proceedings up to CHF 30,000, and Art. 99(3)(a) ZPO does not exempt them from the duty to provide security.

  1. c) Art. 99 ZPO spezifiziert nicht, in welchem Zeitpunkt die (berufungs-)beklagte Partei einen Antrag auf Sicherheitsleistung für ihre Parteientschädigung einzureichen hat; die ZPO kennt auch keine Verwirkungsfolgen bei nicht rechtzeitiger Antragstellung (BK-Sterchi, N 5 zu Art. 99 ZPO; CPC-Tappy, N 14 zu Art. 99 ZPO; Kuster, Stämpflis Handkommentar, N 6 zu Art. 99 ZPO). Ein entsprechender Antrag kann demnach, wie im hier zu beurteilenden Fall, in der Berufungsantwort erfolgen.

d) Grundsätzlich kann die Sicherheit nur für die Zukunft verfügt werden und bereits angefallener Aufwand wird in der Regel nicht von der Kaution gedeckt (Leuenberger/Uffer-Tobler, Schweizerisches Zivilprozessrecht, N 10.24; Suter/von Holzen, in: Sutter-Somm/Hasenböhler/Leuenberger, Kommentar zur Schweizerischen Zivilprozessordnung, N 12 zu Art. 99 ZPO; Kuster, a.a.O., N 6 zu Art. 99 ZPO). Allerdings sind im Berufungsverfahren die bei der Ausarbeitung der Berufungsantwort angefallenen Kosten mit zu berücksichtigen, wenn -  wie hier - der Kautionsantrag mit der Berufungsantwort gestellt wird (vgl. Suter/von Holzen, a.a.O., N 9 zu Art. 100 ZPO; Staehelin/Staehelin/Grolimund, § 16 N 28; noch weitergehend BK-Sterchi, N 9 zu Art. 99 ZPO).

  1. b) Die Lehre ist sich darüber einig, dass arbeitsrechtliche Streitigkeiten nicht von Art. 243 Abs. 2 ZPO erfasst werden, sondern bis zu einem Streitwert von Fr. 30'000.00 in ihrer Eigenschaft als vermögensrechtliche Streitigkeit gemäss Art. 243 Abs. 1 ZPO dem vereinfachten Verfahren unterstehen (BSK-Mazan, N 9 zu Art. 243 ZPO; Giger, Stämpflis Handkommentar, N 3 zu Art. 243 ZPO; Hauck, in: Sutter-Somm/Hasenböhler/ Leuenberger, Kommentar zur Schweizerischen Zivilprozessordnung, N 6 zu Art. 243 ZPO). Art. 99 Abs. 3 lit. a ZPO schliesst vermögensrechtliche Streitigkeiten nach Art. 243 Abs. 1 ZPO von der für das vereinfachte Verfahren aufgestellten Ausnahmeregelung explizit aus, womit die Kautionspflicht gemäss Art. 99 ZPO auch in arbeitsrechtlichen Verfahren bis zu einem Streitwert von Fr. 30'000.00 gilt (Streiff/von Kaenel/Rudolph, Arbeitsvertrag, S. 65).
