Résumé Omnilex

The Regierungsrat held that a neighbor cannot demand the preservation of existing views merely because a new building on the adjacent parcel will diminish them. The decision states that owners have no legal right to unchanged sight conditions; protection of views would require an easement. On that basis, the objection based solely on impaired views was rejected under Art. 4 BauG.

Regeste Omnilex

Art. 4 BauG; impairment of existing view conditions by a new construction as ground for refusal: the mere reduction of neighbors’ sight lines does not constitute a statutory refusal ground. Landowners have no legal claim to the unchanged preservation of existing views vis-à-vis construction measures on neighboring parcels; such protection may arise only from a corresponding servitude. A building permit may therefore not be refused solely because the new building affects the outlook from adjoining properties.

Art. 4 BauG.

Question juridique clé

Whether impaired views of neighboring properties caused by a new building constitute a legal ground to refuse the building permit.

Solution extraite

No. Neighboring owners have no legal entitlement to preserve existing views against construction changes on adjacent land; such protection would require a relevant easement.

Motifs extraits

The mere reduction of existing sight lines is not a statutory refusal ground under Art. 4 BauG. Protection of uninterrupted views can only be secured, if at all, by servitudes on the affected properties.
