Art. 89 KV.

Aufsichtsrecht des Regierungsrates über die Gemeinden.

Entscheid des Regierungsrates vom 29. Oktober 1974 (Nr. 691).

Dieses Recht gibt ihm die Möglichkeit und muss sie ihm geben, willkürliche Gemeinderatsbeschlüsse auch in einem späteren Verfahren als unwirksam zu erklären. Um diese Massnahme zu ergreifen bedarf es übrigens keineswegs unbedingt einer Anzeige oder Beschwerde; der Regierungsrat könnte sie, wiederum kraft seines Aufsichtsrechts, von Amtes wegen ergreifen (vgl. hiezu BGE 99 I 136; Grisel, André: droit administratif Suisse, Neuenburg 1970, S. 140/141).
