The municipal decision of 3 April 1974 had been properly served and contained a remedy instruction, so formal finality had set in. The government also refused to reopen the decision for any formal defect.

Formal legal force of an administrative decision; if a decision is duly served with a correct legal remedy instruction and no appeal is lodged within the appeal period, it becomes formally final and can no longer be reviewed on the merits by the supervisory authority. Absent a relevant procedural defect in service or in the remedy notice, there is no basis for ex officio reopening or reconsideration (consid. 1).

Formelle Rechtskraft eines Entscheides, der nicht innert der Rechtsmittelfrist angefochten wird.

Entscheid des Regierungsrates vom 22. Oktober 1974 (Nr. 668).

Ob indessen der erfolgte Entscheid haltbar sei, kann heute vom Regierungsrat nicht mehr geprüft werden, denn der Gesuchsteller hat es unterlassen, von der ihm zustehenden Beschwerdemöglichkeit Gebrauch zu machen. Der gemeinderätliche Beschluss vom 3. April 1974 war mit einer Rechtsmittelbelehrung versehen und dem Adressaten ordnungsgemäss zugestellt worden, so dass es dem Regierungsrat auch nicht möglich ist, infolge eines formellen Mangels auf diesen Entscheid zurückzukommen.
