Résumé

In Obwalden administrative proceedings, the Government Council confirmed its settled practice of granting a second written exchange only with extreme restraint. Such an exchange is allowed only when required for proper instruction of the case or when the appeal response contains new factual allegations that the appellant could not previously know. The Council saw no reason to depart from this practice, noting that even in administrative court proceedings a second exchange is not available as a matter of course.

Regest

Second written exchange in administrative proceedings; it is granted only exceptionally. In Obwalden, the authorities may allow an additional exchange only where the clarification of the case so requires or where the response introduces new factual allegations unknown to the complainant beforehand. The restraint is justified by the need to avoid undue hindrance of administrative business. The same cautious approach applies mutatis mutandis in administrative judicial proceedings; there is no general entitlement to a second exchange (consid. 1).

Verwaltungsverfahren.

Zweiter Schriftenwechsel.

Entscheid des Regierungsrates vom 2. September 1975 (Nr. 460).
