Der Beschwerdeführer ist der Auffassung, die Rechnung genüge den elementarsten Erfordernissen nicht, welche an die Eröffnung eines den Bürger belastenden Verwaltungsaktes zu stellen seien, da sie weder unterzeichnet noch mit einer Rechtsmittelbelehrung versehen sei; es fehle auch ein Hinweis auf den sie begründenden Gemeinderatsbeschluss. Der Gemeinderat lehnt diese Argumentation ab und beantragt dem Regierungsrat, auf die Beschwerde wegen verspäteter Eingabe nicht einzutreten.

Wie der Beschwerdeführer richtig bemerkt, stellt die Rechnung einen belastenden Verwaltungsakt dar, dessen Formerfordernisse, mit Ausnahme der Frage, ob oder inwieweit eine Begründung erforderlich sei, in Lehre und Rechtsprechung heute kaum mehr umstritten sind. Für die Eröffnung einer Einzelanordnung werden Schriftlichkeit, die Unterschrift derselben sowie die Bezeichnung der Behörde, von der sie getroffen wurde, und eine klare Rechtsmittelbelehrung beinahe einstimmig als minimalste Formerfordernisse erachtet. Diese Anforderungen ergeben sich auch aus der kantonalen Praxis, die zusätzlich, als Ausfluss des Prinzips verwaltungsrechtlicher Ordnung, eine Begründung von belastenden Einzelanordnungen verlangt. Der Regierungsrat sieht deshalb keine Veranlassung, die gegenteilige Auffassung des Gemeinderates zu schützen.
