The Obwalden Regierungsrat held that an agriculturally used property is treated as subject to the federal debt-relief act for agricultural homesteads unless the competent authority expressly removes that status or declares the land no longer agricultural. The owner's objection that no formal subjection decision had ever been issued was therefore immaterial. Because the property was agricultural when the federal act entered into force, it was deemed subject to the act.

Art. 2 Abs. 2 LEG; Art. 1 Abs. 1 Bst. a VV zum LEG: In the canton of Obwalden, every agriculturally used parcel is treated as subject to the federal debt-relief regime for agricultural homesteads unless the competent authority has expressly released it from that status or declared it no longer agricultural. A formal subjection act is not constitutive where the property was already an agricultural homestead at the time the federal act entered into force; the decisive criterion is the objective agricultural character, not the existence of a prior individual subjection decision.

Im Kanton Obwalden ist jedes landwirtschaftlich genutzte Grundstück dem Bundesgesetz über die Entschuldung landwirtschaftlicher Heimwesen unterstellt.

Entscheid des Regierungsrates vom 14. August 1973 (Nr. 527).

Der Einwand, es sei vorliegend nie eine Unterstellung unter das Entschuldungsgesetz erfolgt, ist nicht von Bedeutung. Im Kanton Obwalden wird nämlich jedes landwirtschaftlich genutzte Grundstück als dem Entschuldungsgesetz unterstellt behandelt, wenn es von der zuständigen Behörde nicht von der Unterstellung enthoben bzw. als nicht mehr landwirtschaftlich im Sinne des Bundesgesetzes erklärt wird. Die Liegenschaft war bei der Einführung des Bundesgesetzes über die Entschuldung landwirtschaftlicher Heimwesen ein landwirtschaftliches Heimwesen im Sinne des Gesetzes und somit dem erwähnten Gesetz unterstellt.
