No conciliation jurisdiction over subsidized rent increase

Résumé

The cantonal court held that a dispute over an increase in a subsidized rent does not fall within the ordinary rent-contestation procedure before the regional conciliation authority. Because the dwelling had been financed with public assistance and the rent remained subject to administrative control, Art. 253b para. 3 CO excluded Arts. 269 ff. CO. The court therefore confirmed that the competent bodies for deciding on rent fixation and any further abatements based on the tenant’s personal and income situation are the cantonal housing office and, where applicable, the federal housing office.

The determination of additional rent reductions in view of the tenant’s personal circumstances and income is an administrative matter within the competence of the cantonal housing office, respectively the federal housing office, according to the applicable federal and cantonal legislation.

L'Autorité régionale de conciliation n'est pas compétente pour connaître du litige concernant la hausse d'un loyer subventionné; la fixation du loyer incombe à l'autorité administrative, soit à l'office cantonal du logement en collaboration avec l'office fédéral du logement.

En application de l'article 253b CO, les dispositions relatives à la contestation des loyers, soit les articles 269 ss CO, ne s'appliquent pas aux locaux d'habitation en faveur desquels des mesures d'encouragement ont été prises par les pouvoirs publics et dont le loyer est soumis au contrôle d'une autorité. En l'espèce, l'article 6 des clauses particulières du bail précise que la réalisation de l'immeuble a été financée avec l'aide des pouvoirs publics (Confédération, canton et commune), en application des dispositions légales encourageant la construction et l'accession à la propriété de logements et l'aide au logement, soit la loi fédérale du 4 octobre 1974 encourageant la construction et l'accession à la propriété de logements ( LCAP) et son ordonnance du 30 novembre 1981 (OCAP) et la loi cantonale sur l'aide au logement du 17 décembre 1985 (LAL) et son règlement d'application du 3 septembre 1986 (RAL).

L'examen des conditions auxquelles un locataire a droit à des abaissements supplémentaires de son loyer, compte tenu de sa situation personnelle et de son revenu, relève de la compétence de l'Office cantonal du logement, respectivement de l'Office fédéral du logement en vertu des législations fédérale et cantonale précitées.
