Das Arrestverfahren richtet sich nach den Art. 271 ff. SchKG. Gemäss Art. 275 SchKG gelten die Artikel 91-109 SchKG über die Pfändung sinngemäss für den Arrestvollzug. Danach dürfen nur Vermögenswerte gepfändet werden, die im Eigentum des Schuldners stehen. Die Pfändung von Gegenständen, die offensichtlich einem Dritten gehören, ist nichtig (BGE 105 III 107 ff.). Indessen kann die rechtliche Zugehörigkeit einer Sache unklar oder umstritten sein: so wenn der Schuldner behauptet, ein Dritter sei daran berechtigt, oder wenn ein Dritter selber das Recht darauf für sich beansprucht. In solchen Fällen liegt die Klärung der Rechtslage im Interesse aller Beteiligten, und das Betreibungsamt hat von Amtes wegen das Widerspruchsverfahren einzuleiten (Amonn/Gasser, Grundriss des Schuldbetreibungs- und Konkursrechts, Bern 1997, 6. Aufl., § 24 N 1 ff.).

Einleitung und Durchführung des Widerspruchsverfahrens sind verschieden, je nachdem, ob sich die gepfändete Sache im Gewahrsam des Schuldners oder des Drittansprechers oder in gemeinsamem Gewahrsam des Dritten und des Schuldners befindet (Art. 107 und 108 SchKG). Die Anknüpfung an den Gewahrsam geht von der Vermutung aus, dass dessen Inhaber auch das bessere Recht auf die Sache habe. Darum soll er in einem allfälligen Widerspruchsprozess die prozessual günstigere Rolle des Beklagten einnehmen dürfen (BGE 101 III 26). Das Vorverfahren bereitet diese Parteirollenverteilung vor, indem bei ausschliesslichem Gewahrsam des Schuldners die Klägerrolle im Widerspruchsprozess dem Dritten zufällt (Art. 107 SchKG). Gewahrsam des Dritten wiederum - sei es ausschliesslicher oder gemeinsamer mit dem Schuldner - bedeutet, dass der den Drittanspruch bestreitende Gläubiger oder der Schuldner klagen muss (Art. 108 SchKG). Bei Forderungen, die nicht in einem Wertpapier verkörpert sind, und anderen Rechten wird ersatzweise (anstelle des Gewahrsams) auf die Berechtigung selbst abgestellt. Da aber gerade diese umstritten ist, kommt es für den Entscheid über den "Gewahrsam" zunächst nur auf die grössere Wahrscheinlichkeit der Berechtigung an (Amonn/Gasser, § 24 N 31-37, BGE 120 III 19, Art. 107 und 108 je Abs. 1 Ziff. 2 SchKG). Für die Beurteilung der Gewahrsamsverhältnisse ist dabei der Zeitpunkt der Arrestlegung massgebend (BGE 122 III 437 E. 2.a; Jäger/Walder/Kull/Kottmann, Komm. zum Bundesgesetz über Schuldbetreibung und Konkurs, 4. Aufl., Zürich 1997, Vorbem. zu Art. 107).
