Municipal pre-emption under the Bergregal law, not transfer of the regal right

Résumé Omnilex

The dispute concerned the scope of the municipal preference under § 3(2) of the Bergregal law. The text confirms that the regal right over the listed mineral resources belongs exclusively to the State, while municipalities only enjoy a priority right to obtain a concession among several applicants. To invoke that priority, a municipality must itself conduct exploration and exploitation on its own account and risk and submit financing proof. Because the municipality of X expressly stated that it did not intend to search for or exploit hydrocarbons, it did not exercise the pre-emption right.

Regeste Omnilex

§§ 1–4 Bergregalgesetz; municipal pre-emption right in concession proceedings versus regal right of the State. The statutory scheme reserves the bergregal to the State for the resources listed in § 1 and authorizes the State to prospect for and exploit them or to grant concessions (§ 2). Municipalities situated on the relevant territory are, under § 3 Abs. 2, granted only a preferential right among several applicants, not a claim to transfer of the regal right itself. Exercise of that preference presupposes that the municipality undertakes exploration and exploitation on its own account and risk and furnishes corresponding financing evidence. A mere declaration of not wishing to prospect or exploit does not amount to exercise of the statutory priority; the municipality remains subject to the concession regime and, if it were to use the preference, would owe the concession fee under § 4.

Question juridique clé

Whether the municipality's right under § 3(2) Bergregalgesetz is a right to transfer the regal right itself or only a pre-emption right to a concession.

Solution extraite

The provision grants only a preferential right to obtain a concession, not an entitlement to the regal right itself.

Motifs extraits

The statutory scheme reserves the regal right to the State under § 1 and § 2; municipalities are mentioned only as having priority among applicants under § 3(2). The law therefore concerns concession preference, not uncompensated transfer of the regal right.

Question juridique clé

Whether municipality X exercised its pre-emption right under § 3(2) by its letter of 11 September 1997.

Solution extraite

No. By stating that it did not intend to prospect for or exploit hydrocarbons on municipal land, the municipality did not make use of the priority right in the sense required by the statute.

Motifs extraits

A municipality invoking the preference must itself undertake prospecting and exploitation on its own account and at its own risk and provide the corresponding financing proof. X expressly did not intend to do so.
