Résumé

In a legal aid matter, only the plaintiff was summoned to the second hearing and she appeared with counsel. The court held that counsel’s participation in conciliation proceedings is optional and that such costs are not reimbursable. Only necessary expenses are compensated; legal aid counsel should keep efforts minimal before the higher court confirms the grant of legal aid.

Regest

§ 190 Abs. 1 and 4 ZPO; compensation of counsel’s expenses in conciliation proceedings under legal aid: participation of a lawyer is facultative, and fees for such attendance are not to be reimbursed. Reimbursable are only necessary expenditures; unnecessary or merely convenient representation costs fall outside compensation (cf. consid. on necessity of expenses).

LGVE 1987 I Nr. 39 E. 3 lit.c). LGVE 1988 I Nr. 33).
