Accordingly, the supervisory authority over the notaries has jurisdiction over the entire claim under § 53 BeurkG.

Die von Notar X. erbrachten anwaltlichen Leistungen stehen in unmittelbarem Zusammenhang mit den Beurkundungsgeschäften. Es handelt sich somit um Nebenleistungen zur öffentlichen Beurkundung (Brückner Christian, Schweizerisches Beurkundungsrecht, Zürich 1993, S. 155ff. N 495/96 und 501/02). Sind Entschädigungsansprüche aus Beurkundungstätigkeit und den in Zusammenhang mit einer Beurkundung erbrachten Nebenleistungen streitig, so ist deren rechtskräftige Beurteilung durch die gleiche kantonale Instanz vorzunehmen (Brückner, a.a.O., S. 179 N 583/84; vgl. auch Sidler Kurt, Kurzkommentar zum luzernischen Beurkundungsgesetz, Luzern 1975, N 4 zu § 53, letzter Satz). Die Aufsichtsbehörde über die Urkundspersonen ist somit entsprechend § 53 BeurkG zur Beurteilung der gesamten eingeklagten Forderung zuständig.
