Aus den Erwägungen:

Es ist erstellt, dass Rechtsanwalt X. bereits vor Einreichung des entsprechenden UR-Gesuchs von der Gesuchstellerin einen Geldbetrag erhalten hatte, der zur Honorierung seiner anwaltlichen Bemühungen für das Verfahren nach Art. 175 ZGB bestimmt war. Diese Sachlage hat nach der Weisung der Justizkommission des Obergerichts vom 13. Dezember 1984 (LGVE 1984 I Nr. 20 E. 4b) zur Folge, dass das Recht zur unentgeltlichen Rechtspflege grundsätzlich nur für die über diesen Vorschuss hinausgehenden Kosten zu gewähren ist. Diese Weisung stützt sich auf eine jahrzehntelange Praxis des Luzerner Obergerichts und ist vorab damit begründet, dass in solchen Fällen die fehlende Armut für den bereits geleisteten Vorschuss fingiert werden kann (vgl. Düggelin Walter, Das zivilprozessuale Armenrecht im Kanton Luzern, Diss. Zürich 1986, S. 162 mit Hinweisen). Es kommt hinzu, dass die unentgeltliche Rechtspflege ausschliesslich der Anhebung und Fortsetzung eines Prozesses dient. Daher genügt es, der Partei die künftigen Kostenvorschüsse zu erlassen, weshalb der Anspruch auf Rückerstattung eines vor Einreichung des Gesuchs geleisteten Barvorschusses grundsätzlich zu verneinen ist (Sträuli/Messmer, Komm. zur Zürcherischen Zivilprozessordnung, 2.
