Résumé Omnilex

The defendant sought to have her remedy against a refusal to stay civil proceedings treated as a rekurs. The court held that § 254 ZPO provides a rekurs only against orders granting a stay, not against refusals to stay. The filing was therefore to be treated as a complaint, and the challenged decision was reviewable only for manifest violation of law under § 282(1)(a) ZPO.

Regeste Omnilex

§ 254 ZPO; Rekurs against stay orders and refusal to stay proceedings; the extraordinary remedy is provided only for decisions granting a stay of an appealable civil action. The legislative choice is justified by the potentially irreparable disadvantages of an ordered stay for the opposing party, whereas a refusal to stay ordinarily merely accelerates the proceedings and does not create comparable irreparable procedural or substantive harm. A party challenging a refusal to stay must therefore proceed by complaint; appellate review is then confined to manifest violations of law under § 282(1)(a) ZPO.

Question juridique clé

Whether the defendant's remedy against the refusal to stay the civil proceedings is a rekurs or a complaint.

Solution extraite

A rekurs is not available against a decision refusing a stay; the remedy must be treated as a complaint.

Motifs extraits

Under § 254(2) ZPO, rekurs lies against an order staying an appealable civil case pending another civil or criminal case. The legislature did not provide a rekurs against decisions refusing a stay. Because granting a stay can create serious, sometimes irreparable, consequences, a broad remedy is justified only in that situation; refusal of a stay normally causes no irreparable procedural or substantive harm.

Question juridique clé

What is the standard of review for the defendant's complaint against the refusal to stay proceedings.

Solution extraite

The lower court's decision is reviewed only for manifest violation of law under § 282(1)(a) ZPO.

Motifs extraits

Since the law does not provide a rekurs in this situation (§ 254(1) ZPO), the filed remedy is admissible only as a complaint and the review is limited accordingly.
