Die Beklagte rügt, dass ihr der Amtsgerichtspräsident weder mitgeteilt habe, ob die "für den Fall der rechtlichen Notwendigkeit" offerierten Fr. 10 000.- als Sicherheit zur Abwendung der provisorischen Eintragung genügten, noch Nachfrist zur Leistung einer andern Sicherheit gesetzt habe. Auch diese Rüge ist nicht gerechtfertigt. Der Amtsgerichtspräsident weist in seinem Entscheid zu Recht darauf hin, dass von Gesetzes wegen nicht das Angebot, sondern erst der Vollzug der Sicherstellung beachtlich ist. Erst wenn Ersatzsicherheit geleistet wurde, ist es am Richter zu entscheiden, ob diese auch genügt und dementsprechend die vorläufige Eintragung zu verweigern bzw. allenfalls wieder zu löschen ist. Die Beklagte stellt sich offenbar ein zweistufiges Verfahren vor, nämlich vorerst ein Feststellungsverfahren, ob überhaupt und in welchem Umfang allenfalls Sicherheit zu bieten ist, und dann wohl ein "Auswahlverfahren" für den Schuldner, in welcher Form er die Sicherheit zu leisten wünsche; dass diese Vorstellungen nicht der tatsächlichen gesetzlichen Lösung entsprechen, liegt auf der Hand.
