Résumé Omnilex

The court held that the applicant’s co-ownership share in an inherited house in Calabria had to be treated as an asset relevant to legal-aid assessment. Because the applicant bore the burden of cooperation and proof and did not dispel doubts about the asset, the court assumed he could obtain the necessary funds from it to finance the proceedings. The request for legal aid was therefore refused.

Regeste Omnilex

Legal aid assessment; real property located abroad and inherited co-ownership share as asset to be considered. The applicant bears the burden of cooperation and substantiation and must document the existence, value and realizability of assets. A share in real estate may be deemed available for financing litigation if it can reasonably be monetized; the authority need not ignore it merely because it is jointly owned or abroad. Where the applicant fails to substantiate otherwise, refusal of legal aid is justified.

Question juridique clé

Whether the applicant’s inherited share in the Italian property counts as attachable assets for legal-aid assessment.

Solution extraite

Yes. The inherited real-estate share is a relevant asset in the legal-aid assessment, and the applicant had to substantiate its value and availability.

Motifs extraits

As a matter of principle, the property share is an asset to be considered in the legal-aid procedure. The applicant bears the burden of cooperation and substantiation and must provide full supporting evidence. On that basis, the court assumed he could realize the necessary funds from the property to finance the proceedings.
