Fehlt es an einem realistischen Sicherheitsleistungsgrund, besteht kein schutzwürdiges Interesse an der Anfechtung der unentgeltlichen Rechtspflege; auf den Rekurs ist nicht einzutreten.

Gemäss LGVE 1996 I Nr. 25 E. 5.3 und § 134 Abs. 3 ZPO ist die Gegenpartei zum Rekurs gegen die erteilte unentgeltliche Rechtspflege nur dann legitimiert, wenn für sie ein Gesuch um Sicherheitsleistung ernsthaft in Frage käme, was sie zu belegen hat. Vorliegend argumentiert der Beklagte in seinem Rekurs damit, dass die Klägerin über genügende Mittel zur Prozessfinanzierung verfüge und auf die unentgeltliche Rechtspflege nicht angewiesen sei. Damit fehlt es aber gerade an einem Sicherheitsleistungsgrund gemäss § 125 Abs. 1 ZPO. Wenn eine Partei für die Sicherheitsleistung nicht ernsthaft in Frage kommt, besteht kein schützenswertes Interesse der Gegenpartei an der Verweigerung der unentgeltlichen Rechtspflege, so dass auf den Rekurs nicht einzutreten ist (§ 100 Abs. 1 lit. d i.V.m. § 104 Abs. 3 ZPO).
