Vor einiger Zeit wurde festgestellt, dass mehrere Notariatsbüros zusätzlich im Telefonregister von Ortschaften eingetragen sind, in denen sie keine Räumlichkeiten haben. Dagegen ist seitens der Aufsichtsbehörde über die Urkundspersonen dann nichts einzuwenden, wenn dieser Telefonbucheintrag die korrekte Adresse des Geschäftsdomizils enthält und der Eintragungsort in der gleichen Region liegt.

Es kommt aber auch vor, dass der Telefonbucheintrag eine Adressangabe enthält, an der kein entsprechendes Notariat zu finden ist. Einen solchen Eintrag hält die Aufsichtsbehörde über die Urkundspersonen für generell unzulässig. Damit wird der falsche Eindruck erweckt, man könne an der genannten Adresse ein Notariat aufsuchen. (...) Wer derartige Einträge veranlasst, setzt sich dem Verdacht des Kundenfangs aus.
