The plaintiff appealed the district court divorce judgment and later withdrew his appeal only as to the maintenance provision. He argued that the defendant's cross-appeal concerning women’s maintenance therefore lapsed. The Obergericht rejected this view, holding that the cross-appeal does not fall away by a partial withdrawal of the main appeal. Under § 251(3) ZPO, the cross-appeal falls away only if the main appeal is withdrawn entirely or is not admitted; while the main appeal is pending, the cross-appeal is to be treated as an ordinary appeal.

§ 251 Abs. 3 ZPO; effect of withdrawal of the main appeal on the cross-appeal. The cross-appeal falls away only where the main appeal is withdrawn in the statutory sense or is not admitted. As long as the main appeal remains pending, the cross-appeal retains its procedural autonomy and is to be treated as an ordinary appeal (consid. unspecified). A partial withdrawal of the main appeal does not, by itself, extinguish the cross-appeal insofar as the appeal proceedings continue on other points.

Der Kläger reichte gegen das amtsgerichtliche Scheidungsurteil Appellation ein und beantragte unter anderem die Aufhebung seiner Unterhaltspflicht gegenüber der Beklagten (Ziff. 2 des amtsgerichtlichen Urteilsdispositivs). Die Beklagte erklärte daraufhin Anschlussappellation und beantragte eine abweichende Festsetzung der vorinstanzlich gesprochenen Frauenunterhaltsbeiträge. In der Folge zog der Kläger die Appellationserklärung gegen Dispositiv Ziff. 2 des amtsgerichtlichen Urteils zurück. Dabei vertrat er die Auffassung, dass damit auch die Anschlussappellation der Beklagten in diesem Punkt dahinfalle.

Das Obergericht führte dazu aus:

Hingegen ist die Frage nach dem allfälligen Eintritt der Teilrechtskraft von Dispositiv Ziff. 2 (Frauenunterhaltsbeitrag) des amtsgerichtlichen Urteils bzw. des Dahinfallens der Anschlussappellation infolge Teilrückzugs der Appellation zu verneinen. Gemäss § 251 Abs. 3 ZPO fällt die Anschlussappellation dahin, wenn die Appellation zurückgezogen oder darauf nicht eingetreten wird. Die Anschlussappellation ist indes als ordentliche Appellation zu behandeln, solange die Hauptappellation hängig ist (Studer/Rüegg/Eiholzer, Der Luzerner Zivilprozess, N 3 zu § 251 ZPO).
