Résumé Omnilex

The plaintiff challenged the defendant's representation before the labor court by Z., who was responsible for payroll and simultaneously served as a labor court lay judge. The Obergericht held that this constellation did not amount to a procedural defect and, by itself, did not justify recusal or indicate bias. The plaintiff did not concretely allege partiality, and the file revealed no signs of it. The nullity complaint was therefore dismissed.

Regeste Omnilex

Appearance of a legal entity before the labor court by a person who is at the same time a labor court lay judge and responsible for payroll does not, by itself, constitute a serious procedural defect or a ground for recusal; decisive is whether concrete indications of bias exist. The mere systemic possibility of such a constellation under the lay-judge system is insufficient, absent specific evidence that the court was actually partial (consid. not stated).

August 1997 abgewiesen.)

Question juridique clé

Whether the defendant's appearance through Z. constituted a serious procedural defect.

Solution extraite

No. A legal entity may appear through such a person; there was no obvious procedural defect.

Motifs extraits

The fact that Z. was a labor court lay judge responsible for payroll at the defendant does not prevent him from appearing as the defendant's representative before the labor court.

Question juridique clé

Whether Z.'s dual role created a ground for recusal or showed bias of the labor court.

Solution extraite

No. The system of lay judges at the labor court can lead to this constellation and that alone does not create a recusal ground; no concrete bias was shown.

Motifs extraits

The court noted that the paritically composed labor court was not concretely alleged to have been biased, and the file contained no indications of impartiality.
