The City of Geneva had lent one of its employees CHF 21,890.25, interest-free, to finance a pension buyout payable in monthly instalments. After the employee resigned in 1992, the city paid a vested benefits amount and then demanded repayment of the remaining loan balance of CHF 10,169.85, together with interest credited by CAP on the buyout sums over the years of affiliation. The tribunal held that it had jurisdiction, confirmed repayment of the outstanding principal, but rejected the claim for interest because the loan was expressly interest-free and the CAP statutes did not provide for attribution of those interest amounts to the city.
LPP art. 73; repayment of a pension buyout loan and entitlement to credited interest: where an employer grants an employee an interest-free loan to finance a pension buyout, the remaining capital may be reclaimed upon the employee’s departure if it remains contractually due; however, absent an express statutory or contractual basis, the lender cannot also demand the interest credited by the pension institution on the buyout amounts. The mere financing purpose of the loan does not transfer to the employer any right to the civil fruits generated within the pension scheme (consid. not stated).

Résumé
L'office du personnel de la Ville de Genève a prêté à une de ses employées Frs 21'890,25, ne portant pas intérêts et remboursables en 325 mois à partir du 1er juillet 1978, afin de payer la somme de rachat due à la CAP. L'employée a démissionné en 1992. La Ville de Genève lui a versé Frs 88'624,95 à titre de prestation de libre passage définitif. La Ville de Genève a, par la suite, réclamé le remboursement du solde du capital prêté, soit Frs 10'169,85, plus les intérêts bonifiés par la CAP sur le rachat des années d'affiliation. Le TA s'est déclaré compétent, a confirmé la décision sur le remboursement du solde du capital prêté, mais a admis le recours pour la demande en paiement des intérêts, dès lors que le prêt avait été consenti sans intérêts et que l'attribution à la Ville de Genève des intérêts sur la somme de rachat ne résultait pas des statuts de la CAP.
