Résumé

The court upheld the continuation of removal detention. It relied on the person’s conviction for selling cocaine, the resulting danger to others, and the fact that he had already been expelled from Switzerland roughly one year earlier, which supported the assessment of recidivism and the need for detention.

Art. 13b al. 1 let. b LSEE; prolongation of expulsion detention on account of danger and recidivism risk: detention may be maintained where the foreign national has been convicted of a serious narcotics offence and concrete circumstances show a continuing risk to public safety or a likelihood of renewed offending, in particular when a prior expulsion was recently disregarded.
