Résumé

The court confirmed the extension of detention pending expulsion. It held that the imminent departure, combined with the detainee’s failure to attend the appointment set by the OCP, constituted an indicium of evasion of removal and justified continued detention under the cited provision.

LFSEE art. 13b al. 1 let. c; detention for removal purposes may be maintained where concrete indications of evasion exist. Imminence of departure and the person's failure to appear at an appointment fixed by the competent migration authority are relevant factors; non-attendance may constitute an indicium of attempted evasion of refoulement and support the assessment of flight risk or concealment risk. The continuation of detention is upheld where these circumstances, considered together, make removal enforcement appear jeopardized.
