The court held that a social-housing tenant did not satisfy the conditions of Art. 39A LGL by stating that he was not seeking a cheaper apartment because he expected a second child. It further held that his status as a member of the cooperative owning the building did not exempt him from the obligation to move to another apartment. The challenge was dismissed.
Art. 39A LGL; obligation to change apartment in social housing; the tenant must satisfy the statutory conditions for remaining in the dwelling. A personal wish to keep the apartment because of an anticipated second child does not by itself defeat the relocation requirement.
