The Tribunal administratif held that it was competent to examine whether an employee should have been affiliated by the employer to the company pension fund. The court did not decide in the abstract whether a 15-day interruption clause in the employment contract applied to the case, but found that, on the facts, the employee had ceased working for less than 15 days and therefore should have remained insured under the occupational pension scheme.

The administrative court is competent to review whether an employee had to be affiliated to the employer’s pension fund. The question whether a contractual clause deeming a 15-day interruption to constitute a break in employment is applicable may remain open where, in any event, the interruption actually lasted less than 15 days. In such circumstances, the employee must be regarded as having remained insured; short cessations of work do not suffice to interrupt the affiliation requirement.

Résumé
Le TA est compétent pour examiner si un employé aurait dû être affilié par son employeur au fond de prévoyance de l'entreprise. Question laissée ouverte de savoir si le délai de 15 jours fixé dans le contrat de travail comme correspondant à une rupture du contrat du point de vue de la LPP est applicable au cas d'espèce. En l'espèce, état donné que l'intéressé a cessé de travailler pendant moins de 15 jours, il aurait dû être assuré.
