In a reconstruction case governed simultaneously by the LGL and the LDTR, the court held that the rent-fixing mechanism under the LGL does not displace the separate LDTR control of admissible rents. A rent that may qualify for subsidization under the LGL is not necessarily acceptable under the LDTR. Otherwise, the assessment of the population's preponderant interest would effectively be removed from the department and appeal authorities and left to the housing finance office and the State Council.
LDTR art. 6 al. 6; when a reconstruction falls within both the LGL and the LDTR, the rent admissibility mechanism of the LGL does not supersede the LDTR review. A rent accepted for subsidization under the LGL is not for that reason alone admissible under the LDTR. To hold otherwise would deprive the department and the reviewing authorities of the control of the statutory criterion of the population's preponderant interest, whose application cannot be absorbed by the financial housing authorities under the LGL.

Résumé
Rien ne permet de faire prévaloir le mécanisme de fixation des loyers prévus par la LGL sur l'examen prévu par la LDTR lorsqu'une reconstruction implique l'application de ces deux lois. En d'autres termes, tout loyer admissible pour un subventionnement selon la LGL n'est pas forcément admissible selon la LDTR. Le contraire reviendrait notamment à soustraire en pratique au département et aux autorités de recours l'application et le contrôle de la notion d'intérêt prépondérant de la population qui deviendrait, de fait, l'apanage exclusif de l'office financier du logement et du Conseil d'Etat, selon les articles 15 ss LGL.
