The administrative court upheld a two-month driver’s license withdrawal imposed for speeding. It held that it had no reason to depart from the criminal court’s findings, because the criminal judge is in principle the authority that must first determine whether the offense was committed. The appeal against the duration and basis of the withdrawal was therefore rejected.
LCR art. 16 al. 2 and 17 al. 1; withdrawal of driving licence for speeding; the administrative authority is generally bound by the criminal court’s findings on the commission of the offense, absent compelling reasons to depart from them. The administrative judge need not re-examine the established facts where the criminal judge has already ruled on the offense (consid. 2). The duration of the measure is upheld where no error in the factual premise or in the application of the legal criteria is shown.
