Résumé

The court held that although the appellant had been pursued by the vehicle behind him, he was not entitled to brandish a firearm and simulate loading while a round was already chambered. Such conduct, carried out in the city center, was deemed dangerous and serious. The seizure of all of his weapons was therefore justified.

Art. 5 al. 1 CCAM; seizure of weapons; danger and legitimate self-defense. A person who is being followed may not rely on self-defense to display a firearm by manipulating it with a round already in the chamber. Such conduct, particularly in a public urban setting, constitutes serious dangerous behavior and may justify the seizure of all weapons. The assessment turns on the objective dangerousness of the act, not merely on the existence of a preceding threat.

Résumé

Même si le recourant a effectivement été poursuivi par le véhicule qui le suivait, il ne lui était pas permis d'exhiber une arme à feu en effectuant un mouvement de charge avec une balle engagée dans le canon. Une telle manipulation d'arme, de surcroît effectuée au centre ville, constitue un comportement dangereux et grave. Le séquestre de toutes les armes du recourant est en conséquence justifié.
