Résumé

The administrative court held that it lacked jurisdiction to hear an appeal against a decree appointing a civil servant. Under the cantonal administrative procedure rules, the court acts in single instance only for monetary claims based on cantonal public law. An appointment decree is instead challenged by opposition, and the competent examination commission submits a proposal to the Executive Council, which decides in final instance. No appeal lies to the administrative court.

Art. 11 LTA; jurisdiction of the administrative court in single-instance proceedings is limited to pecuniary claims founded on cantonal public law. Appointment decrees for public servants are not directly appealable to the administrative court; they are subject to opposition, after which the competent examination commission proposes a decision to the Executive Council, which rules in final instance. Decisions taken in the hiring/appointment phase do not open an administrative-court remedy absent an express statutory basis; lack of jurisdiction must therefore be noted ex officio.

Le TA n'a pas la compétence de connaître des recours à l'encontre d'un arrêté de nomination d'un fonctionnaire. Il ne connaît en instance unique que des actions relatives à des prétentions de nature pécuniaire fondées sur le droit public cantonal au sens de l'art. 11 al. 1 litt. a LTA. Un arrêté de nomination est susceptible d'opposition, à l'exclusion des décisions prises lors de l'engagement. La commission d'examen compétente formule une proposition au CE, lequel statue en dernier ressort. Il n'existe aucune voie de recours au TA.
