Invalidity assessment without earnings comparison in adapted former work

Résumé

The court held that the insured was able to resume work at 50% provided that he avoided heavy lifting. His former occupation remained suitable in an adapted form, especially after the employer had adjusted the workplace. Because the insured nevertheless showed no willingness to return and was dismissed, the insurer did not have to carry out a separate comparison of earnings when determining the degree of invalidity. The incapacity in the adapted former job was treated as corresponding to the incapacity to earn.

Art. 18 al. 2 and Art. 19 al. 1 LAA; determination of invalidity where the insured can still perform the former occupation in an adapted form: if the former activity remains suitable notwithstanding functional limitations, the incapacity to work in that post may coincide with the incapacity to earn, so that a separate comparison of earnings is unnecessary. A workplace adaptation by the employer and the insured's refusal to resume work may reinforce this assessment. The decisive factor is the actual residual work capacity in the adapted activity, not the abstract exclusion of the former job.

Cas dans lequel il a été admis que l'assuré pouvait reprendre le travail à 50% tout en évitant le port de lourdes charges. Son ancienne activité n'était pas exclue, dans la mesure où elle était adaptée. L'employeur ayant dans un premier temps aménagé la place de travail afin de faciliter la tâche de l'intéressé et celui-ci ayant marqué son manque de volonté de réintégrer son poste, il a été licencié. Dans ces conditions, l'assurance n'avait pas à procéder, dans l'optique de déterminer le degré d'invalidité de son assuré, à une comparaison de gain, l'incapacité de travail de l'assuré dans son ancien poste correspondant à son incapacité de gain.
