The case concerns an insured person who suffered a minor fall on stairs at a swimming pool and later claimed benefits for shoulder injury and psychological sequelae. The court denied adequate causal connection between the benign accident and the psychological disorders. It nevertheless confirmed the assessment of a 10% impairment of physical integrity in relation to the physical injury. The decision therefore separates the psychical consequences from the somatic harm and maintains the physical impairment assessment.
LAA art. 6 para. 1 and art. 18; adequate causality for psychological sequelae after an accident. A minor accident of low intensity does not, absent special circumstances, justify attributing later psychological disorders to the event under the theory of adequate causation. By contrast, where the somatic consequences of the accident are established, the assessment of impairment of physical integrity may be confirmed independently of the denial of psychical causation.
