Résumé

The case concerns a restaurant's request to extend its terrace with two additional tables on the public domain. The court held that the public interest in ensuring fluid and normal pedestrian circulation, particularly for schoolchildren, outweighs the restaurant's private economic interest. The authorization was therefore refused and the appeal dismissed.

Regest

LR.56 al.1; use of the public domain for a restaurant terrace may be refused where it would hinder the normal and safe flow of pedestrian traffic. The balancing of interests gives priority to the public interest in unobstructed circulation, particularly where schoolchildren or other vulnerable pedestrians are affected, over the operator's merely economic interest in additional seating. A limited private commercial benefit does not justify encroachment on pedestrian access.
