A pedestrian struck by a car suffered an elbow wound and later claimed psychological sequelae. The court held that the event had to be classified as a medium accident. In such a case, adequate causation between the accident and psychological disorders is not presumed; it requires examination of the criteria developed by the Federal Insurance Court. The decision therefore confirms the need for a structured adequacy analysis before liability for psychiatric consequences can be accepted.

A road traffic accident involving a pedestrian struck by a vehicle and suffering only limited bodily injury is to be qualified according to its overall seriousness; where the accident falls within the intermediate category, the existence of adequate causal connection with later psychological disorders depends on a case-specific assessment of the established criteria of accident severity and post-traumatic development, as developed in the Federal Insurance Court case law. Adequacy cannot be inferred solely from the occurrence of psychiatric symptoms after the accident.
